    1. 1. General Payment
        1. 1.1.
          In these Terms and Conditions the following expressions shall have the following meanings:
            1. 1.1.a.
              Customer shall mean you and all of the people who purchase any product(s) sold by Aeras Medical.
            1. 1.1.b.
              "Intellectual Property" shall mean all intellectual property rights of whatsoever nature, including (without limitation) patents, designs, present and future trademark or copyright, whether or not registered or registrable by any means, and the right to file an application for registration thereof.
          1. 1.1.c.
            "Product/Products" shall mean any and all the products or services for sale by Aeras Medical Pte Ltd.
          2. 1.1.d.
            "Aeras Medical" shall mean Aeras Medical Pte Ltd who is the seller of the products featured in Aeras Medical online-store
          3. 1.1.e.
            "Aeras Medical online-store " shall mean this Internet site or catalogues owned by Aeras Medical Pte Ltd and the medium by which Products are offered for sale by Aeras Medical to the Customer.
        2. 1.2.
          All the Products sold by Aeras Medical through this site are subjected to these Terms and Conditions. By submitting your order for processing by Aeras Medical, you confirm and affirm that you have read, understood and agree to the Terms and Conditions in the form in which they appear at the time your order is submitted for processing
        3. 1.3.
          The Customer shall agree to complete the registration process according to Aeras Medical's requirements as stated on this site. The Customer shall provide Aeras Medical with complete and updated information which shall include (but shall not be limited to) the Customer's legal name, address, telephone and fax numbers (optional) and e-mail address
        4. 1.4.
          The Customer will be liable for every order made under his purchase/transaction and agrees to indemnify Aeras Medical for all claims, damages whatsoever made by any third party arising from the actions of a person placing orders for the Products using the Customer's purchase/transaction. The Customer shall be responsible for updating his registration information.
      1. 1.5.
        The Customer may place his order via our website at: http://www.aerasmedical.com The Customer will receive a confirmation of receipt of order via e-mail. For clarification, such confirmation of receipt of orders does not guarantee stock availability.
    1. 2. Price
      1. 2.1.
        Aeras Medical shall make every effort to ensure the prices, details and sizes of the Products detailed by the Aeras Medical online-store are correct.
      2. 2.2.
        All promotions and offers by Aeras Medical are subjected to a set of terms and conditions, which we reserve the right to change without prior notice, in the best interests of the company.
      3. 2.3.
        The right to amend terms and conditions includes changing the price of the promotion or offer, terminating the offer before stated validity date, changing the details of the promotion or offer or any other changes in order to protect the interests of the company or under circumstances of abuse.
      4. 2.4.
        Vouchers issued by Aeras Medical are not valid for use together with promotions or offers.
    1. 3. Payment
        1. 3.1.
          Payment for Products ordered through Aeras Medical online-store can be made via PayPal/Cash(for self-collection).
        1. 3.2.
          Aeras Medical may change at any time the method by which payments for Aeras Medical online-store orders may be effected and such changes may be notified to the Customer by e-mail or by placing a notice to this effect on the Aeras Medical website.
      1. 3.3.
        All online payments made through Paypal are beyond the control of Aeras Medical and hence, are solely the responsibility between the customer and Paypal. Aeras Medical shall hold no responsibility for any dispute between the customer and Paypal that may occur during the payment process.
    1. 4. Delivery
            1. 4.1.a.
              Aeras Medical shall use every reasonable endeavors to deliver Products of acceptable quality to the delivery address (specified by the Customer on the registration form) but Aeras Medical shall not be liable for any delays in its delivery services, if the delay has been due to causes beyond the control of Aeras Medical.
            1. 4.1.b.
              Aeras Medical will call the phone number provided by the customer to arrange for a delivery. Should the customer be unable to accept the delivery on the mutually agreed date, period of time and location provided, and does not inform Aeras Medical at least 1 working day prior to the mutually agreed date of delivery, an additional charge of S$10.00 (w/o GST) will be imposed on top of the first delivery charge of S$10.00 for the second delivery attempt.
          1. 4.1.c.
            The additional charge of S$10.00 for the second delivery attempt also applies to order amount greater than S$100.00 where the delivery was free of charge as per clause 4.3.
        1. 4.2.
          Aeras Medical will only effect delivery to mainland Singapore excluding Airport/ Sentosa / Jurong Island / Cargo Complex excluding Saturday, Sunday & Public Holidays.
        1. Delivery Information: Order received before 3.00pm on a working day: Delivery will be made within 3 working days between 9.00am – 5.00pm excluding Saturday, Sunday & Public Holidays.
        2. 4.3.
          There will be a S$10.00 (excluding GST) Delivery charge for order amount lower than S$100.00 within Singapore. There will be no delivery charge for order amount equal to/greater than S$100.00
        1. 4.4.
          There will be additional charges for special delivery requirements including overseas purchase. Please enquire via email : sales@aerasmedical.com or contact Aeras Medical at +65 6752 0290 before making purchase online.
      1. 4.5.
        The Customer is to notify Aeras Medical immediately of a change to his/her delivery address and contact number at least one working day in advance before the agreed upon delivery schedule.

    1. 5. Self-Collection
      1. 5.1.
        If the customer indicated “self-collection” under the purchase option, Aeras Medical will make reasonable effort to contact the customer (based on the contact details provided by the customer) to confirm the availability of ordered goods for self-collection on the prefered date the customer has indicated. Prior to collection of goods, please contact Aeras Medical at +65 6752 0290 for confirmation. Relevant cash payment or proof of purchase must be brought along to collect purchased goods.

      3. Collection Time: Weekdays between 9am - 11.30am or 1.30pm - 5.30pm. (Except public holidays).
    1. 6. Cancellation of Orders
      1. 6.1.
        Please contact Aeras Medical at +65 6752 0290 immediately regarding order cancellations.
      2. Aeras Medical will only accept a notice of cancellation from customer if the notice is given to Aeras Medical before the delivery of goods has been made to the customer (based on the mutually agreed date, time period and location). Aeras Medical shall not accept any notice of cancellation from the customer after the order has been delivered to the customer.
    1. 7. Exchange of Products / Refunds for discrepancy in amount charged.
        1. 7.1.
          Aeras Medical shall use its best efforts to ensure that orders are correctly fulfilled. Should there be any discrepancy, please notify us either by e-mail at sales@aerasmedical.com or call Aeras Medical Customer Service at +65 6752 0290 as soon as possible or by the next working day.
        1. 7.2.
          All goods purchased are not returnable due to hygiene purpose (For a blood glucose monitoring system, this includes meter kit, test strips, lancets and alcohol pads.)
        1. 7.3.
          Exchanges can be arranged under the following circumstances.
          1. 7.3.a.
            If any Product was delivered in a damaged condition, or if the Product is expired, or if the wrong Product is delivered, Aeras Medical shall replace the Product.
          2. 7.3.b.
            If a Customer is charged more than the value of a Product, Aeras Medical shall refund to the Customer the difference.
        1. 7.4.
          All refunds will be made within 5 working days.
      1. 7.5.
        All replacements of Products shall be effected in the shortest time possible.
    1. 8. Force Majeure
      1. 8.1.
        Aeras Medical shall not be held liable for any failure or delay in performing its obligations under this agreement if such failure or delay is the result of an act of God (including but not limited to events such as flooding, earthquakes, or other natural disasters) or unnatural disruptions (including but not limited to events such as war, terrorist attacks, labor disputes, government sanctions, failure of external third parties) and any other events beyond the control of Aeras Medical.
    1. 9. Variation of Terms & Conditions
      1. 9.1.
        Aeras Medical reserves the right to amend these Terms and Conditions at its sole discretion. Aeras Medical may, but does not undertake, to notify the Customer of such changes. It is the Customer's responsibility to review the Terms and Conditions prior to submitting any order and Aeras Medical shall have no responsibility to notify the Customer of any changes to the Terms and Conditions prior to the coming into effect of such changes or otherwise.
    1. 10. Applicable Law
      1. 10.1.
        These Terms and Conditions shall be governed by the laws of Singapore and the Customer and Aeras Medical agree to submit to the jurisdiction of the Singapore courts.
    1. 11. Personal Data
      1. 11.1.
        The Customer authorizes Aeras Medical to collect, retain and use personal information about the Customer for the following purposes:
          1. 11.1.a.
            Undertaking any dealings or transactions with the Customer and providing continuous services to the Customer;
          1. 11.1.b.
            Enforcing of any legal or other rights Aeras Medical have against the Customer in any manner that Aeras Medical sees fit;
          1. 11.1.c.
            Assessing the Customer's credit-worthiness;
          1. 11.1.d.
            Making such disclosures as may in Aeras Medical opinion be required for any of the above purposes;
          1. 11.1.e.
            Sending the Customer any advertising and/or promotional material;
          1. 11.1.f.
            Designing services for Customers;
          1. 11.1.g.
            Conducting research, such as research to determine which areas are not meeting Aeras Medical Customers' needs;
          1. 11.1.h.
            Notifying Customers of special offers or new Products;
          1. 11.1.i.
            Notifying Customer of updates to this site/catalogue;
          1. 11.1.j.
            Performing statistical and analysis of Customers' behavior and characteristics in order to measure interest in and use of the various areas of this site and providing this information to advertisers together with information as to the number of users that have been exposed to or clicked on their banners
      2. 11.2.
        The Customer further authorizes Aeras Medical to collect personal information about the Customer from the Customer or any other source available to Aeras Medical including but not limited to credit referral agencies, the Customer's bank (present and past) and other suppliers or products and services to the Customer and other persons or companies with whom the Customer will have been associated.
      3. 11.3.
        The Customer is aware that in the event that sufficient personal information is not supplied, or is not satisfactory to Aeras Medical then his/her transaction in the Aeras Medical online-store may not be accepted.
      4. 11.4.
        The Customer is aware that any personal information supplied by the Customer will be retained by Aeras Medical and will be accessible to Aeras Medical employees and other persons or bodies corporate engaged by Aeras Medical for or in relation to any of the purposes listed in Clause 10.1. above, or to third parties as stated in Clause 11 below and the Customer authorizes Aeras Medical to disclose all or any part of any personal information provided by the Customer to such third parties.
      5. 11.5.
        The Customer acknowledges that Aeras Medical shall retain all personal information supplied by the Customer and unless otherwise notified to Aeras Medical may continue to contact the Customer with marketing information even after the Customer's registration is cancelled.
    1. 12. Confidentiality
        1. 12.1.
          Aeras Medical does not sell, rent or lease its Customer lists to any third party.
        2. 12.2.
          Personal data held by Aeras Medical relating to its Customers or to visitors to this site will be kept confidential. However Aeras Medical may provide this information to third parties in relation to services provided by Aeras Medical. All such third parties are prohibited from using Customer's personal data except to provide the requisite services to Aeras Medical and they are required to maintain the confidentiality of such data.
        1. 12.3.
          Any questions, comments, suggestions or information other than personal data sent or posted to this site, or any part of this site by online Customers and visitors will be deemed voluntarily provided to Aeras Medical on a non-confidential and non-proprietary basis. Aeras Medical reserves the right to use, reproduce, disclose, transmit, publish, broadcast and/or post elsewhere such information freely, including passing it to any associated company for example, in connection with the development, manufactured and marketing of products and services and to meet Customer needs.
      1. 12.4.
        Aeras Medical will disclose Customer's personal data, without notice, only if required to do so by law or in the good faith belief that such action is necessary to:
        1. 12.4.a.
          Comply with legal process served on Aeras Medical or the site;
        2. 12.4.b.
          Protect and defend the rights or property of Aeras Medical and
        3. 12.4.c.
          Act under exigent circumstances to protect the personal safety of users of Aeras Medical, the Aeras Medical internet site or the public.
    1. 13. Content
      1. 13.1.
        All reasonable efforts are made to ensure that the information provided on this site is correct and up-to-date. However, Aeras Medical disclaims all implied and/or express warranties and makes no representation as to the accuracy or completeness of any information on the site. Aeras Medical takes no responsibility and assumes no liability for the content of the site or for anything posted on or linked to it, including without limitation any mistake, error, omission, infringement, defamation, falsehood, or other material or omission that might offend or otherwise give rise to any claim or complaint.

        Aeras Medical had established an information security policy for the prevention and detection of unauthorized access or misuse of information with the following methods:

  1. 15. Warranty Policy
        1. 15.1.
          The warranty provided by Aeras Medical does not apply to goods:
          1. a) damaged due to misuse, abuse, flood, fire, earthquake or other external causes
          2. b) damaged from operating the product not in accordance with the instructions / permitted / intended uses described by Aeras Medical.
          3. c) Normal wear and tear of goods are not included in this warranty.
          4. d) Serial number of the device has been removed or altered.
          5. e) Damaged or tampered with by anyone who is not a representative of Aeras Medical.
          6. 15.1 a)
            Aeras Medical’s warranty obligations are only valid in Singapore, subject to the successful completion of the Warranty registration.
      1. 15.2.
        The TRUEresult meters (not including other accessories and consumables provided along with the kit) are covered by a lifetime warranty. The terms and conditions of the lifetime warranty are as follows:

        1. 15.2 a)
          The warranty is valid only if the warranty registered online on the Aeras Medical webpage within 30 days from purchase/ Warranty card is completely filled out and returned to Aeras Medical within 30 days of Purchase

        1. 15.2 b)
          The lifetime warranty applies to the meter only, and does not extend to other accessories and consumables provided along with this kit.

        1. 15.2 c)
          Aeras Medical Pte Ltd makes no warranties which extend in regards to the damages that occur due to deterioration of meter by wear and tear; damage due to use of chemicals or corrosion; accidents, damage due to water contact, customer mishandling, tampering, abuse or use not in accordance with the instructions for use.

        1. 15.2 d)
          Should you suspect something is amiss with your TRUEresult blood glucose monitoring system, please call Aeras Medical at +65 6752 0290. Aeras Medical is not responsible for any direct, special, incidental or consequential damages inflicted by the Customer on his/her own TRUEresult meter(s) and is not obliged to replace the customer’s meter.

        1. 15.2 e)
          If the problem with your meter cannot be corrected, Aeras Medical Pte Ltd agrees to replace the blood glucose meter with an equivalent meter, at no cost to you, except for transportation charges for the meter you are returning to our service center. This charges will be paid for by the customer.
        2. 15.2 f)
          This warranty is voided if the meter is tampered with or opened by a third party not authorised by Aeras Medical Pte Ltd; and in the event of any alteration / removal of the serial number embodied on the product.

        1. 15.3.
          iHealth Devices are covered by a 1 Year warranty starting from the date of purchase shown on the receipt. As Aeras Medical is not the exclusive distributor for iHealth, we will only service iHealth products sold through Aeras Medical. For clarification, please contact Aeras Medical at +65 6752 0290.

Customer is aware that in the event that sufficient personal information is not supplied, or is not satisfactory to Aeras Medical then his/her transaction in the Aeras Medical online-store may not be accepted. may receive notices from us if the Product and/or the Adapter is ever recalled.
